Services may include hypnosis sessions, consultation calls, online sessions where appropriate, self-hypnosis education, educational resources, downloadable materials, email communication, appointment scheduling, and related personal development support, collectively referred to as the “Service.”
Use of EmergeHypnosisCo.com, including all materials presented on the Site and all services provided by Emerge Hypnosis LLC, is subject to these Terms and Conditions. These Terms and Conditions apply to all site visitors, prospective clients, clients, customers, and all other users of the Site.
By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
USE OF THE SITE AND SERVICE
To access or use the Site or Service, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions.
Children under the age of 18 are prohibited from using the Site or Service without the consent and involvement of a parent or legal guardian.
Information provided on the Site and through the Service related to hypnosis, self-hypnosis education, personal development, habits, motivation, performance, confidence, identity, belonging, follow-through, and related topics is subject to change.
Emerge Hypnosis LLC makes reasonable efforts to provide accurate and current information. However, we make no representation or warranty that the information provided, regardless of its source, referred to as the “Content,” is accurate, complete, reliable, current, or error-free. Emerge Hypnosis LLC disclaims liability for any inaccuracy, error, or incompleteness in the Content to the fullest extent permitted by law.
NATURE OF SERVICES
Emerge Hypnosis LLC provides hypnosis and self-hypnosis education for vocational, avocational, educational, and personal development purposes only.
Services may address areas such as procrastination, over-preparation, confidence, motivation, habits, performance, self-image, follow-through, identity, belonging, and adoption-related personal development.
Services are not psychotherapy, counseling, medical care, psychological services, diagnosis, or treatment for any medical, psychological, psychiatric, emotional, or mental health condition.
Nothing on the Site, in any session, consultation, form, resource, or communication should be understood as medical advice, mental health advice, diagnosis, treatment, or a substitute for services provided by an appropriately licensed professional.
If you have a medical condition, mental health concern, psychiatric diagnosis, substance use concern, crisis situation, or symptoms requiring professional evaluation, you should consult an appropriate licensed professional.
If you are experiencing an emergency, call 911 or go to the nearest emergency room. If you are experiencing a mental health crisis, contact an appropriate crisis service or licensed mental health professional.
NO GUARANTEES
Hypnosis and self-hypnosis education are personal development services. Results vary from person to person.
Emerge Hypnosis LLC does not guarantee any specific result, outcome, timeline, habit change, performance result, emotional result, business result, financial result, relationship result, or life outcome.
Any testimonials, examples, descriptions of possible outcomes, or client experiences are illustrative only and do not guarantee that you will experience the same or similar results.
Client participation, readiness, honesty, consistency, and follow-through may influence the usefulness of the work.
CONSULTATIONS AND CLIENT SUITABILITY
A consultation or inquiry does not guarantee acceptance as a client.
Emerge Hypnosis LLC reserves the right to decline, discontinue, or refer out services if we determine that the Service may not be appropriate for your goals, needs, location, circumstances, or scope of concern.
We may recommend that you consult a licensed medical, mental health, legal, financial, or other professional where appropriate.
ACCOUNT CREATION
The Site may allow you to submit forms, request consultations, schedule appointments, access resources, or use third-party scheduling or payment platforms.
If an account, login, scheduling profile, or intake form is required, you agree to provide accurate, complete, and current information. You must not impersonate someone else or provide information, contact details, or payment information that is not your own.
You are responsible for maintaining the confidentiality of any account credentials used through third-party platforms connected to the Site.
You agree not to use the Site or Service for any illegal or unauthorized purpose.
LAWFUL PURPOSES
You may use the Site and Service for lawful purposes only.
You agree to be financially responsible for all purchases, bookings, and payments made by you or someone acting on your behalf through the Site or through any third-party scheduling or payment platform connected to Emerge Hypnosis LLC.
You agree to use the Site and Service for legitimate, personal, non-commercial purposes only unless we have given written permission otherwise.
You shall not post, transmit, submit, or send through the Site any material that violates or infringes the rights of others, is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, obscene, unlawful, misleading, harmful, or otherwise objectionable.
You shall not use the Site or Service in any way that could damage, disable, overburden, impair, or interfere with the Site, Service, or any other party’s use of the Site or Service.
REFUSAL OF SERVICE
The Services are offered subject to our acceptance of your request, booking, or order.
We reserve the right to refuse service to any person, request, booking, or entity to the fullest extent permitted by law.
No service request is deemed accepted until confirmed by Emerge Hypnosis LLC. No paid service is deemed accepted until payment has been processed or other written payment arrangements have been made.
We may change, modify, limit, suspend, or discontinue any aspect or feature of the Site or Service at any time, subject to fulfilling any existing responsibilities to you based on services already accepted and paid for.
ORDER AND APPOINTMENT CONFIRMATION
If you schedule a consultation, purchase a service, request an appointment, or submit a form, we may email or otherwise contact you to confirm details.
In the event there is an error in your appointment confirmation, payment confirmation, email, intake form, or related communication, it is your responsibility to inform us as soon as possible.
CANCELLATIONS, RESCHEDULING, REFUNDS, AND MISSED APPOINTMENTS
Fees for completed sessions are non-refundable.
Unless otherwise stated in writing, clients are expected to provide at least 48 hours’ notice to cancel or reschedule an appointment.
Appointments canceled or rescheduled with less than 48 hours’ notice may be considered a late cancellation and may result in the session being forfeited or a cancellation fee being charged.
Missed appointments or no-shows may result in the session being forfeited and are not refundable.
Prepaid packages, if offered, are subject to the terms provided at the time of purchase or in the applicable client agreement. Unused sessions may be eligible for rescheduling, credit, or refund only as stated in writing by Emerge Hypnosis LLC.
Emerge Hypnosis LLC reserves the right to cancel or reschedule appointments due to illness, emergency, technology issues, scheduling conflicts, or circumstances beyond our control. If Emerge Hypnosis LLC cancels a paid appointment, reasonable efforts will be made to reschedule the appointment or provide an appropriate credit or refund for the affected service.
ONLINE SERVICES
Emerge Hypnosis LLC may provide online hypnosis sessions, consultation calls, and self-hypnosis education where appropriate.
Online services may not be appropriate for every person, goal, concern, or circumstance. We reserve the right to determine whether online services appear appropriate for a prospective client.
You are responsible for participating from a private, safe, and distraction-free location. You should not participate in hypnosis, self-hypnosis, or related services while driving, operating machinery, supervising dependents, or engaging in any activity that requires alert attention.
You are responsible for maintaining the technology, internet connection, device, privacy, and environment necessary to participate in online services.
MATERIAL YOU SUBMIT TO THE SITE
You shall not upload, post, email, submit, or otherwise make available through the Site any artwork, photos, documents, writings, recordings, or other materials, collectively referred to as “Materials,” that are protected by copyright, trademark, privacy rights, publicity rights, or other proprietary rights without the express written permission of the owner.
You are responsible for determining whether any Materials you submit are legally protected or restricted.
You represent and warrant that you have the authority to submit any Materials you provide and that the use or display of those Materials will not violate any laws, rules, regulations, or rights of third parties.
You agree not to submit medical emergencies, mental health crisis information, or urgent safety concerns through the Site. If you are experiencing an emergency, call 911 or seek immediate professional assistance.
INTELLECTUAL PROPERTY RIGHTS TO YOUR MATERIALS
Emerge Hypnosis LLC claims no ownership rights over materials you submit to us, except as necessary to provide the Service, respond to inquiries, process forms, maintain records, or conduct business operations.
Content you submit remains yours to the extent that you have any legal rights in it.
By submitting Materials through the Site or Service, you grant Emerge Hypnosis LLC a limited, nonexclusive license to use those Materials for the purpose of responding to you, providing services, administering the Site, maintaining records, fulfilling legal or business obligations, and communicating with you.

ADDITIONALLY, EMERGE HYPNOSIS LLC IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH: ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELAY, DENIAL OF SERVICE, COMPUTER VIRUS, SYSTEM FAILURE, WEBSITE UNAVAILABILITY, THIRD-PARTY PLATFORM ISSUE, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, OR THIRD-PARTY THEFT, DESTRUCTION, UNAUTHORIZED ACCESS, ALTERATION, OR USE OF YOUR INFORMATION OR PROPERTY.
THE FOREGOING APPLIES REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY, AND EVEN IF EMERGE HYPNOSIS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
IN NO EVENT SHALL EMERGE HYPNOSIS LLC’S CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO EMERGE HYPNOSIS LLC FOR THE SERVICE GIVING RISE TO THE CLAIM. IF NO PURCHASE HAS BEEN MADE BY YOU, EMERGE HYPNOSIS LLC’S CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Emerge Hypnosis LLC, its owner, employees, contractors, representatives, agents, affiliates, and service providers from and against any and all losses, damages, liabilities, claims, causes of action, settlements, costs, charges, assessments, and expenses, including reasonable attorney’s fees, arising out of or related to:
- your breach of these Terms and Conditions;
- your use or misuse of the Site or Service;
- your violation of any law, rule, regulation, or third-party right;
- your submission of any Materials through the Site or Service;
- your reliance on Site Content or Service information beyond its intended personal development purpose; or

You agree to provide reasonable assistance, without charge, as we may request in connection with the defense of any claim. You shall not settle any third-party claim or waive any defense without our prior written consent.
EFFECT OF HEADINGS
The headings of the paragraphs and sections in these Terms and Conditions are included for convenience only and shall not affect the construction or interpretation of any provision.
ENTIRE AGREEMENT; WAIVER
These Terms and Conditions, together with the Privacy Policy, Disclaimer, any applicable client agreement, and any written service-specific terms provided by Emerge Hypnosis LLC, constitute the entire agreement between you and Emerge Hypnosis LLC pertaining to the Site and Service.
These Terms supersede all prior and contemporaneous agreements, representations, and understandings between you and Emerge Hypnosis LLC regarding the Site and Service.
No waiver of any provision of these Terms and Conditions by Emerge Hypnosis LLC shall be deemed or constitute a waiver of any other provision, whether or not similar. No waiver shall constitute a continuing waiver. No waiver shall be binding unless made in writing by Emerge Hypnosis LLC.
CONFLICT WITH CLIENT AGREEMENT
If you become a client of Emerge Hypnosis LLC and sign or agree to a separate client agreement, informed consent, service agreement, disclosure, or package agreement, those terms may provide additional terms specific to your services.
If there is a conflict between these website Terms and a signed or written client agreement, the client agreement will control as to the specific services covered by that agreement, unless otherwise required by law.

GOVERNING LAW; VENUE; MEDIATION
These Terms and Conditions shall be construed in accordance with and governed by the laws of the State of California, without regard to conflict of law principles.
To the fullest extent permitted by law, the exclusive venue for any court proceeding based on or arising out of these Terms and Conditions, the Site, or the Service shall be in Orange County, California.
The parties agree to attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms and Conditions through informal discussion first.
If informal discussion does not resolve the matter, the parties agree to attempt to resolve the dispute through mediation before pursuing litigation or another available legal or equitable remedy, unless emergency relief, injunctive relief, debt collection, or another exception is permitted by law.
RECOVERY OF LITIGATION EXPENSES
If any legal action, mediation, arbitration, or other proceeding is brought for enforcement of these Terms and Conditions, or because of an alleged dispute, breach, default, or misrepresentation related to these Terms and Conditions, the prevailing party may be entitled to recover reasonable attorney’s fees and costs to the extent permitted by law.
SEVERABILITY
If any term, provision, covenant, or condition of these Terms and Conditions is held by a court, arbitrator, or other competent authority to be invalid, void, or unenforceable, the remaining provisions shall remain in full force and effect and shall not be affected, impaired, or invalidated.
ASSIGNMENT
These Terms and Conditions bind and inure to the benefit of the parties and their respective successors and permitted assigns.
You may not assign, delegate, sublicense, or otherwise transfer your rights or obligations under these Terms and Conditions without prior written consent from Emerge Hypnosis LLC.
Any attempted assignment, delegation, sublicense, or transfer by you without written consent is invalid.
